​Rental and Sales Conditions Discolife

​General (sales, rental of goods and rental of services)

​​All conditions included below apply to all deliveries / installations, invoices, orders and rental contracts performed by us. You are deemed to accept these terms and conditions expressly and unambiguously at the time you place an order, place an order or enter into a rental contract signs. ​We only accept written orders and assignments. If we have agreed on the price by telephone, you must still confirm the price in a letter or email you sign for approval.

​If the term has not been expressly determined, our price offer is binding up to and including 15 days after the offer has been drawn up by us, subject to missing and/or force majeure. Inaccuracies in the quotation must be reported to us in writing within 3 days after you have received the quotation. The listed prices on the contracts and on quotations include 21% VAT, unless stated otherwise.

​Retention of title

​The following retention of title applies to all our sales: Discolife reserves the ownership of all delivered and yet to be delivered goods. The placed The materials always remain the property of Discolife and can under no circumstances serve as collateral or be the subject of a seizure.

​Payment

​You pay an invoice at the latest on the due date, you pay a rental receipt when you pick up or deliver the material. If you do not pay on time, we will charge you a fixed compensation of 15% of the total amount with a minimum of €50 and the statutory maximum late payment interest applicable at that time. This is done without prior notice of default. Each started month counts as a full month. All outstanding invoices and/or rental receipts will be payable from the moment you do not pay and all orders and/or deliveries still to be performed are postponed until you have paid all arrears has.

​Complaints

​Complaints must be reported to us within 8 days of receiving the invoice by registered letter, after which no complaint will be admissible. If there are any disputes arise, only the courts of the district of Bruges are competent. In that case, keep in mind that you will pay legal costs and executive costs will have to wear.

​Rental of goods/services

​We only rent equipment that is in perfect condition. You are obliged to see visible defects, these are defects that manifest themselves from the first use, immediately to report to us. You may only sublet equipment with our written consent. You are obliged to treat the appliances with due care. Some special conditions:

  • I​If we find food residues, residues of drinks, mud, cigarettes,... on our appliances, we will charge you reconditioning costs at €30/hour incl 21% VAT for cleaning work and minor repairs. For internal cleaning of delicate parts and repairs, wear the integral repair and transport costs of a specialized repair service.
  • ​You pay € 1.5 per cable that you do not return properly coiled.
  • ​You must transport rented equipment in an adapted vehicle or in a closed trailer.
  • ​You may not change any settings on devices or cabling that have been set/made by us
  • ​You must at all times grant Discolife access to the rented goods and disclaim any third-party claims on the rented goods.

​Rental term

​A rental period runs as agreed in the quotation. If you return the goods late or make it impossible for us to collect them at the agreed time, we will charge you a full rental day for each rental period started. 
If you wish to rent several days, there are special coefficients for this.

​Theft / Loss

​In the event of irreparable damage or theft or loss, the replacement value will be charged.

​Injury

​If you do not return or damage rental equipment, you will bear the full repair and replacement costs.

​Rental deposit

​When we ask for a rental deposit, you will receive this cash back when the rented goods are returned correctly and on time. If necessary, this rental deposit can be withheld in whole or in part as an advance on repairs, reconditioning or replacement costs and as extra rent for late returns.

​The insurance of the rented equipment against theft or breakage is at the expense and at the initiative of the tenant/organizer.

​Cancellation conditions

​You can cancel the contract free of charge up to and including 60 days before the start of the contract. After the 60th day we will charge an expense allowance that is as is calculated as follows:

  • ​Between the 60th and 14th day before the start of the agreement, you pay 25% of the agreed total amount.
  • ​Between the 14th and 4th day before the start of the agreement, you pay 50% of the agreed total amount.
  • ​During the last 3 days before the start of the agreement you pay 75% of the agreed total amount.

​Due to the nature of the sector, a week consists of 7 working days.

​If Discolife wishes to cancel the agreement, you are also entitled to the above cancellation rates. The client can never claim a higher compensation than the above cancellation rates. Discolife has the right to terminate the agreement at any time and without compensation. to be canceled in the event that the client: shows serious indications of insolvency, the safety of our personnel or our equipment directly or seriously endangers, is suspected of fraud or acts with malicious intent by failing to take the necessary security measures.

​Placement and operation

​​You must provide sufficient space at the entrance of the event location to load and unload with a truck. You also need a parking space for a delivery van or truck within a radius of 50 meters unless otherwise agreed in writing. 
At least 2 tables must be present at the installation site and there must be more than enough space to place all rented equipment. 
If the location is difficult to reach (stairs or +30m distance between the place where the installation has to be and the unloading point or other obstacles), you must do this at the to report a booking. Unless otherwise agreed in writing, all equipment must be placed in a dry, hardened and frost-free place. The power supply must be solid and earthed and may deviate by max 5pct from 50Hz 400V with power current or 230V AC with regular sockets. Also, the power supply at a maximum distance of 10m from the installation site, unless specifically agreed otherwise. 
Overloading of the network is at the expense of the tenant/organizer. 
Like us, you must strictly adhere to agreements about operating, installation or collection times. If the conditions in the above paragraph are not met, Discolife cannot be held responsible for the late delivery of the installation. Discolife may also decide, without you being entitled to compensation, not to use part or all of the equipment. until the problem is solved.

​Overtime

​Overtime that arises due to non-compliance with the above conditions or because the client does not adhere to agreed times or if production takes longer than agreed, charges will be made, unless otherwise agreed in the rental contract.

​During their activity, our staff must have access to free entrance and refreshments. For productions that fall within normal lunch hours, You can also provide a small meal for our staff.

​Noise level

​As an organizer you are always liable for the noise level used, even if an employee of Discolife operates the installation. We are happy to follow your instructions regarding the desired sound pressure and can provide measuring equipment for a modest additional cost and/or contractually stipulate a sound limit. to which we commit ourselves so as not to exceed these. 
If the applicable sound standards are repeatedly exceeded, Discolife has the right to stop the musical activity after a first notification. In case of exceeding these noise standards, possible fines are borne by the DJ / Organizer / Tenant. ​The renter / Organizer declares to be aware of the operation of the individual components and that he will take the necessary care to avoid overloading and avoid other damage.
